Terms and Conditions

TERMS AND CONDITIONS Last updated: October 11, 2026 These terms apply to the website and direct online services of Sushi Mito, 6470 Spalding Drive, Peachtree Corners, GA 30092. Please read them before using our services or submitting an order. Additional terms disclosed for a particular service or at checkout also apply. Nothing here removes consumer rights or remedies that cannot be excluded under applicable law. 1. Using our services You must be at least 18, or use our services under the supervision of a parent or guardian who is responsible for the transaction. Provide accurate contact, order, and payment information and use only a payment method you are authorized to use. Where an account is available, keep your sign-in details secure and contact us if you suspect unauthorized activity. Do not submit fraudulent orders, misuse customer information, disrupt the website, or attempt unauthorized access. 2. Menu, availability, and prices Menu items, ingredients, seasonal offerings, hours, and availability can change. Photographs are illustrative; actual presentation may vary. Prices are in U.S. dollars unless otherwise stated and may differ between dine-in, direct ordering, and third-party platforms. Review the order total, taxes, and any disclosed charges before submitting payment. Tips are optional unless a clearly disclosed service or gratuity policy applies to your purchase. If an item or price is incorrect or unavailable, we will contact you about available options rather than make an undisclosed charge or substitution. 3. Orders and confirmation Review your items, quantities, requested time, contact details, and fulfillment method before submitting an order. An automated acknowledgment or payment authorization alone does not necessarily mean the restaurant has accepted an order. Acceptance is subject to the confirmation provided by the ordering service and restaurant availability. We may decline an order for an unavailable item, inability to fulfill it, a payment problem, or suspected misuse, consistent with applicable law. If a declined order was charged, contact us so we can arrange the appropriate refund or payment reversal. 4. Pickup and delivery Pickup and delivery times are estimates and may be affected by order volume, preparation, weather, traffic, or other circumstances. Delivery is available only when offered for your address at checkout. Follow the confirmation instructions and collect your order promptly. For delivery, provide a complete address and be available to receive it. Contact us immediately if the address, requested time, or receipt of the order is incorrect. Third-party delivery orders are also subject to the platform's fulfillment and support terms. 5. Changes, cancellations, and refunds Call 770-734-0398 or 770-209-9663 as soon as possible to request an order change or cancellation. Online editing or cancellation may not be available, and a request is not confirmed until the restaurant accepts it. Once preparation begins or an order is fulfilled, a discretionary cancellation or refund may not be available. This does not limit remedies required by law for an incorrect, missing, unsafe, or otherwise defective order. Please report an order problem promptly with your order reference and a description of the issue. We will review it and discuss an appropriate resolution, which may include correcting the order, a replacement, or a partial or full refund as appropriate. Approved refunds are normally returned through the original payment method; the time for a credit to appear depends on the payment provider and your bank. For orders placed through another platform, use that platform's support process unless it directs you to us. 6. Allergies, dietary requests, and raw food Tell restaurant staff about any food allergy before ordering and ask about the specific dish. A note submitted online does not guarantee that an accommodation is possible; call the restaurant to confirm. Our kitchen handles multiple ingredients and shared preparation areas, so we cannot guarantee that any item is free from allergens or cross-contact. Ingredient information and dietary descriptions should not replace a discussion with staff about your needs. Eating raw or undercooked seafood, meat, poultry, or eggs can increase the risk of foodborne illness. People who are pregnant, older adults, young children, and people with weakened immune systems should be particularly cautious and choose fully cooked foods. Ask staff about cooked alternatives. This advisory does not waive any food-safety obligation or legal right. 7. Reservations and special orders Where reservations, catering, or special orders are offered, acceptance and availability must be confirmed by the restaurant. Any deposit, cancellation deadline, minimum spend, or no-show charge must be disclosed for that booking before you agree. Contact us promptly if your party size or plans change. These terms do not create a fee that was not disclosed and accepted. 8. Alcohol, gift cards, and promotions Alcohol is available only through services and fulfillment methods permitted by law. Purchasers and recipients must be at least 21 and present valid identification when required; service may be refused as permitted by law. Gift cards, loyalty programs, and promotions, where offered, are subject to their separately disclosed terms and applicable law. Check eligibility, exclusions, and redemption conditions before purchasing or redeeming an offer. 9. Website content and third-party services Restaurant names, logos, photographs, and other website materials belong to their respective owners or are used with permission. Personal browsing and use of the ordering services do not grant permission to reproduce materials for commercial use. External links and third-party ordering, payment, or booking services have their own terms and privacy policies. Website availability can be interrupted by maintenance or technical problems; call the restaurant for assistance. 10. Privacy, applicable law, and updates Our Privacy Policy explains how information is handled. These terms are governed by applicable Georgia law and federal law, without displacing any mandatory protections that apply to you. Please contact us first about a concern so we can try to resolve it. These terms do not require arbitration or waive access to remedies provided by law. If one provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. We may update these terms for future use of our services. The updated date will appear above. Changes do not retroactively alter a confirmed order or booking unless you agree or the law requires it. Contact Sushi Mito: 770-734-0398 or 770-209-9663.
